Your agreement with QLTY Services, LLC

These Terms of Service ("Terms" or "Agreement") are a legally binding contract between you and QLTY Services, LLC ("QLTY Services," "Quality Roots," "we," "us," or "our"). This Agreement governs your access to and use of our website, mobile app, social media channels, and all related digital services (collectively, the "Quality Roots Platform").

By browsing our website or app — including simply viewing product pages — you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated here by reference.

If you do not agree to these Terms in their entirety, please stop using the Quality Roots Platform immediately.

Updates to these Terms

We reserve the right to update these Terms at any time. Changes take effect when posted to this page with a revised date. Your continued use of the Platform after any update means you accept the revised Terms.

02 — ELIGIBILITY

Age requirements & cannabis compliance

QLTY Services, LLC is a licensed cannabis retailer. Access to our Platform is strictly age-restricted in accordance with applicable state cannabis laws.

• Recreational customers: Adults 21 years of age or older
• Medical patients: Adults 18 years of age or older with a valid state-issued medical marijuana registry card

By accessing the Platform, you represent that you meet the applicable age requirement and will not misrepresent your age at any point — online or in-store. Minors are strictly prohibited from using this Platform. If we discover a minor has accessed the Platform or created an account, we will immediately terminate that account and delete the associated data.

03 — USAGE

Permitted & prohibited use

QLTY Services, LLC grants you a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes only.

You may

• Browse our product catalog and cannabis educational content
• Create an account to manage orders and loyalty rewards
• Place online pre-orders for in-store pickup or delivery where available
• Contact our team through provided support channels
• Share links to our public pages for personal, non-commercial purposes

You may not

• Violate any federal, state, or local laws or cannabis regulations
• Copy, reproduce, sell, or commercially exploit any portion of the Platform or its content without written consent
• Use bots, scrapers, crawlers, or any automated tools to access the Platform
• Disrupt or interfere with the Platform’s function or other users’ experience
• Share your login credentials or allow others to use your account
• Impersonate any person or entity, or misrepresent your age or identity

Violations may result in immediate account termination, order cancellation, and legal action where warranted.

04 — CONTENT

Intellectual property

All content on the Quality Roots Platform — including text, graphics, photographs, product descriptions, logos, brand assets, pricing information, educational articles, and cannabis guides — is the property of QLTY Services, LLC or its licensors, protected by applicable copyright, trademark, and intellectual property laws.

Without our prior written consent, you may not reproduce, modify, frame, embed, or systematically extract any content from the Platform, or use Quality Roots brand assets in any unauthorized manner.

05 — TRANSACTIONS

Online ordering & payment

You may browse our menu and place online pre-orders through the Platform for pickup at any Quality Roots dispensary location. All orders are subject to product availability and applicable state cannabis regulations.

Bank-linked payments on this site are processed by Aeropay, Inc. By connecting a bank account and using the pay-by-bank option, you also agree to Aeropay's Terms of Service.

QLTY Services, LLC does not collect or process debit or credit card information online. No payment is taken at the time of placing an order. All purchases are completed in person, in cash, at the dispensary at time of pickup.

Payment options may vary by location or change as cannabis banking regulations evolve. Check with your local Quality Roots dispensary for current options.

Order pickup

All orders require age and identity verification at the time of pickup. You must present a valid, government-issued photo ID. We reserve the right to refuse service to anyone who cannot verify their age or identity, or who appears impaired at the time of pickup.

06 — DATA

Collection & use of personal information

When you use the Quality Roots Platform, we may collect identifying information including your name, email, phone number, date of birth, government-issued ID information, and purchase history — as required by applicable cannabis laws and to provide our services.

We use this information to verify your identity and age, process and fulfill orders, communicate with you about your account and promotions, and improve our services.

Third-Party Marketing & Data Services

We may use third-party marketing, analytics, and data service providers, including Retention.com, to help us understand visitor activity, improve our communications, measure campaign performance, and market the Quality Roots Platform.

These services may use cookies, pixels, device identifiers, browsing activity, and similar information as described in our Privacy Policy. Our use of Retention.com is also subject to the Retention.com Terms of Service.

07 — COMMUNICATIONS

Customer communications & messaging

QLTY Services, LLC may contact you through SMS/text message, phone call, email, and direct mail to support your experience with Quality Roots.

Types of messages we send

• Order & pickup updates — confirmations, ready-for-pickup notifications, and order status changes
• Promotions & deals — special offers, new product announcements, and dispensary events
• Loyalty & rewards — point balances, tier updates, and exclusive member benefits

How you opt in

You may consent to receive communications from QLTY Services, LLC at the time of online account signup, at checkout in-store, or both. By providing your phone number or email address and checking the applicable consent box, you expressly consent to receive messages from us at that number or address.

For SMS and phone calls, your consent constitutes your prior express written consent under the Telephone Consumer Protection Act (TCPA). Message and data rates may apply. Message frequency varies.

How to opt out

• SMS: Reply STOP to any text message at any time. You will receive a single confirmation and no further messages will be sent.
• Phone calls: Inform any Quality Roots representative that you wish to be removed from our call list, or contact us at the address below.
• Email: Click the unsubscribe link in any marketing email, or contact us directly. Note that transactional emails (e.g. order confirmations) are not subject to marketing opt-outs.
• Direct mail: Contact us at the address below to be removed from our mailing list.

Opting out of marketing communications will not affect your ability to place orders or use the Platform. You may still receive transactional messages necessary to fulfill your orders.

CAN-SPAM & TCPA compliance

All email communications from QLTY Services, LLC comply with the CAN-SPAM Act. Each marketing email will clearly identify QLTY Services, LLC as the sender, include our valid physical mailing address, and provide a clear and easy mechanism to unsubscribe.

All SMS and telephone communications comply with the Telephone Consumer Protection Act (TCPA) and applicable state laws. We will not send unsolicited text messages or place autodialed calls to any number without your prior express written consent. To register your number on the National Do Not Call Registry, visit donotcall.gov.

THIS PLATFORM DOES NOT PROVIDE MEDICAL ADVICE. Nothing on the Quality Roots Platform constitutes the practice of medicine, a medical recommendation, or a substitute for professional medical advice, diagnosis, or treatment.

All product information, cannabis educational content, dosage guidance, and consumption tips on this Platform are provided for general informational and educational purposes only.

Always consult a qualified healthcare professional before using cannabis for any medical purpose, combining it with medications, or if you are pregnant, nursing, or managing a chronic health condition.

In a medical emergency, call 911 immediately. Do not rely on this Platform for emergency guidance.

09 — WARRANTIES & LIABILITY

Disclaimer of warranties & limitation of liability

The Quality Roots Platform and all content, products, and services are provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by law, QLTY Services, LLC disclaims all warranties — express or implied — including those of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted access.

To the maximum extent permitted by applicable law, QLTY Services, LLC and its officers, directors, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of — or inability to use — the Platform.

Some jurisdictions do not permit certain warranty exclusions or liability limitations. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.

10 — LEGAL

Governing law, severability & entire agreement

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Oakland County, Michigan.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in full force and effect. These Terms, together with our Privacy Policy and any additional service-specific terms, constitute the entire agreement between you and QLTY Services, LLC regarding your use of the Platform.
